Congratulations on purchasing this protection plan. Please carefully read the terms and conditions to understand the coverage provided under this plan.

STANDARD TERMS AND CONDITIONS

  1. DEFINITIONS

1.1 Plan(s): Refers to any or all of the products/services packages offered by JAVIN from time to time, with optional add-on components or features as detailed in the Welcome letter kit/Welcome email/Welcome message.

1.2 Plan Fee: The fee charged by JAVIN for the Plan(s) availed by the Customer, as outlined in the respective Plan Terms. The Plan Fee is inclusive of all applicable taxes.

1.3 Plan Terms: Specific terms and conditions provided separately, applicable to each Plan(s).

1.4 Cancellation Period: The number of days from the date of activation of the Plan(s) within which the Customer may cancel the Plan(s) and receive a full refund of the Plan Fee.

1.5 Insurer: A third-party insurance company registered with the Insurance Regulatory and Development Authority of India, partnered with JAVIN.

1.6 Service Partner: Any third-party logistics or repairs service provider affiliated with JAVIN.

1.7 Personal Information/Data: Includes personal and financial information of the Customer, such as data/documents, bank account details, identification documents, etc.

  1. PURPOSE

2.1 These terms and conditions govern the transaction between JAVIN and the Customer regarding the Plan(s) provided by JAVIN.

2.2 General terms and conditions establish the framework and obligations of the parties, with specific terms and conditions for each Plan(s) provided in writing as Plan Terms.

2.3 Customer acknowledges receipt of the Terms and Plan Terms, agreeing to be fully bound by them.

  1. CUSTOMER CONSENTS AND CONFIRMATIONS

3.1 Customer consents to the use of Personal Information by JAVIN for providing services under the Plan(s).

3.2 Customer consents to the disclosure of Personal Information to third parties, including insurers and service partners, for service fulfillment or as required by law.

3.3 Customer expressly consents to recording phone calls for record-keeping, monitoring quality standards, training, and meeting legal requirements.

3.4 Customer acknowledges JAVIN’s right to vary Plan(s) features/benefits, Plan Fee, or terms.

3.5 Customer consents to JAVIN appointing employees/collection agents to collect amounts payable, at the sole risk and cost of the Customer.

3.6 Customer consents to JAVIN engaging third parties, including Service Partners, for service fulfillment, disclosing relevant information.

3.7 Customer consents to JAVIN identifying other service providers or products of potential interest.

3.8 Customer consents to receiving periodic SMS/WhatsApp/email communications from JAVIN regarding product features/services.

  1. TOTAL FEES/CHARGES

4.1 JAVIN charges the Plan Fee for the respective Plan(s), payable in advance. The Customer may make a one-time payment or authorize deductions from their bank/credit/debit card.

4.2 Plan Fee(s) are detailed in the respective Plan Terms.

4.3 Activation is subject to realization/receipt of the Plan Fee.

  1. SERVICING OF SERVICE REQUESTS & CLAIMS

5.1 Claim approval is at JAVIN’s and/or the insurer’s discretion.

5.2 Service requests or claims are subject to compliance with Terms, Plan Terms, providing accurate information, acting in good faith, and meeting specified requirements.

5.3 JAVIN is not obliged to entertain claims unless the Customer is over 18, a resident of India, and the Plan Fee is paid up to the date of the claim.

  1. CANCELLATIONS/ RENEWAL/TERMINATION

6.1 JAVIN may cancel Terms and/or Plan Terms for non-receipt of the Plan Fee.

6.2 We can certainly refund the plan within 30days provided you have not already filed a service request.

6.3 Customer-initiated cancellations within the Cancellation Period receive a full refund. After, no refund is available.

  1. CONFIDENTIALITY

7.1 JAVIN makes efforts to keep Personal Information confidential, disclosing only as required for service fulfillment.

  1. REPRESENTATIONS AND WARRANTIES

8.1 Customer represents being over 18, a resident of India, and compliance with applicable laws.

8.2 Customer affirms the accuracy of provided Personal Information.

  1. OBLIGATIONS AND COVENANTS OF THE CUSTOMER

9.1 JAVIN may recover payments if benefits were obtained dishonestly or fraudulently.

9.2 Customer must comply with Plan(s) usage terms.

9.3 The Plan(s) is not an insurance product; insurance is an optional add-on feature.

9.4 Customer must not misuse Plan(s) for prohibited activities.

  1. LIMITATION OF LIABILITY

10.1 JAVIN is not liable for incidental, consequential, exemplary, or indirect damages. Disclaimers include implied warranties of merchantability, fitness for a particular purpose, and non-infringement. JAVIN’s total liability is limited to the Plan Fee.

  1. INDEMNITY

11.1 Customer agrees to indemnify JAVIN and its officers from losses, damages, liabilities, costs, and expenses arising from wrongful acts, misconduct, failure to comply with laws, breach of representations, or third-party claims.

  1. NOTICES

12.1 Notices must be in writing and delivered, sent by registered mail, or overnight courier to the specified address.

  1. MISCELLANEOUS

13.1 The Terms benefit JAVIN’s legal successors. No assignment is possible except as stated.

13.2 JAVIN is not liable for delays or failures beyond its control.

13.3 JAVIN reserves the right to amend the Terms and Plan Terms, with amendments effective immediately.

13.4 The Agreement is governed by Indian law, with disputes subject to arbitration in Mumbai, with English as the language.

These terms and conditions constitute the entire agreement, superseding all previous communications, and may be amended by JAVIN with notice to the Customer
